The Ministry of Commerce issued Notification No. 46/2018 on 18 September 2018 prohibiting multi-level marketing (Mondaq article on Notification 46/2018). The article says companies with wholesale or retail trading licences may keep trading, including direct sales and online sales, as long as no MLM activity is involved. A draft Direct Selling Law in 2020 would lift the ban (VDB Loi article, July 2020), but we could not confirm that it has been passed. The VDB Loi article, July 2020 describes a 2020 draft: a certificate from the Department of Consumer Affairs, reports on sales and on agents' operations and profits, and bans on operating without a certificate and on forcing people to buy goods to become agents, with up to two years in prison and a fine of up to MMK 300 million. It is a draft, so treat it as a sign of direction, not as current law.
